Introduction
 

Effective upon engagement with Energy Savings Guru Limited (“ESG”), these terms and conditions govern the services provided by ESG. By using our services, you signify your agreement to these terms. If you do not agree, please refrain from using our services.

1. Price Comparison and Switching Services
 

ESG provides price comparison and switching services for UK-based businesses. To use our services, customers must:

  • Be a UK-based business.

  • Be 18 years or older (if operating as a sole trader).

  • Meet the credit requirements of relevant suppliers (where applicable).

We reserve the right to refuse services at our discretion.

By using our services, you agree to provide accurate and complete information, including energy usage, contract end dates, and other relevant details. ESG endeavors to negotiate competitive rates from a wide panel of suppliers. However, quotes are subject to suppliers' terms and are not binding until a contract is executed between you and the supplier.

If a contract is agreed upon, ESG will facilitate the switching or renewal process but is not liable for delays, supplier failures, or changes in market conditions. You acknowledge that your contract is directly with the energy supplier, not ESG.
 

2. Charges
 

ESG is remunerated via commissions paid by suppliers, typically through an uplift applied to your energy unit cost. For example, if we secure a rate of 26p per kWh and apply an uplift of 0.9p, the rate offered would be 26.9p. Commissions vary based on contract size, term, and other factors.

3. Duplicate Contracts and Fees
 

If you enter into a duplicate contract with another supplier after agreeing to a contract through ESG, resulting in the failure of the ESG-facilitated contract, ESG reserves the right to charge:

  • A “Failed Contract” fee of £750 per meter plus VAT, or

  • The full commission ESG would have earned on the failed contract—whichever is greater.

This fee is separate from any charges levied by the supplier.
 

4. Change of Tenancy (COT) Notifications
 

If you move premises during a contract, this is classified as a COT, which may alter the supplier's payment of ESG fees. To avoid additional charges, notify ESG at least 14 days prior to the contract’s end. Failure to do so may result in:

  • A “Failed Contract” fee of £750 per meter plus VAT, or

  • The full commission ESG would have earned, adjusted for the proportion of the contract fulfilled—whichever is greater.
     

5. Failure to Go Live

If a contract fails to commence due to missing or incomplete information provided by you or due to supplier refusal, ESG reserves the right to charge £750 per meter plus VAT. Required information includes, but is not limited to:

  • Signed letters of authority.

  • Meter numbers.

  • Accurate contract start/end dates.

  • Termination notifications and banking details.

6. Supplier Failure
 

If your supplier ceases trading and you are moved to a Supplier of Last Resort (SOLR), ESG may not receive its commission. In such cases, ESG reserves the right to charge £750 per meter plus VAT if fees are unpaid. At our discretion, we may waive this fee if you allow ESG to assist with transitioning to a new supplier.
 

7. Guaranteed Energy Renewal Savings Terms
 

ESG guarantees to beat the initial renewal quote provided by your current supplier for 1, 2, or 3-year fixed-term energy contracts. If we cannot beat the quote, we will pay up to £1,000, subject to the following conditions:

  • The competing renewal offer must be provided in writing or via email and must match the contract details offered by ESG (e.g., fully fixed rate, term, annual consumption, and meter number).

  • The offer applies only to new ESG customers operating as small or medium enterprises.

  • Claims must be submitted within 120 days of the renewal letter or email, and the contract start date must be within this timeframe.

ESG reserves the right to amend or withdraw this guarantee at any time.
 

8. Auto Renewal
 

If you have granted ESG delegated authority (DA) to renew your energy contract, our Auto Renewal terms and conditions also apply.
 

9. General Terms
 

  • Independent Status: ESG acts as an independent energy brokerage and is not your agent or representative.

  • Supplier Liabilities: ESG is not responsible for the quality of supplier services, delays, or market fluctuations.

  • Customer Responsibility: It is your responsibility to validate quotations, confirm contract submissions, and ensure contracts go live.
